Terms of sale
These General Terms and Conditions of Sale (the “General Terms and Conditions of Sale” or “GTC”) govern all commercial relations between the parties and all services provided and sales made in France or abroad by FULLLIFE, a simplified joint-stock company with share capital of EUR 1,500, registered with the Bayonne Trade and Companies Register under number 885 191 940, whose registered office is at 65 rue d'Espagne, 64200 Biarritz, France, represented by Mr Alexandre MALSCH (hereinafter “FULLLIFE”), whose business consists of selling clothing inspired by gaming and esports culture online.
FULLLIFE and the USER or PLAYER are hereinafter individually referred to as a “PARTY” and collectively as the “PARTIES”.
IMPORTANT
ANY USE OF THE SHOP, FOR ANY PURPOSE WHATSOEVER, NECESSARILY IMPLIES THE USER'S UNRESERVED ACCEPTANCE OF THESE GENERAL TERMS AND CONDITIONS OF SALE (GTC).
THESE GTC ARE AVAILABLE AT HTTPS://WWW.FULL.LIFE/CGV.
ANY ORDER PLACED WITH FULLLIFE AUTOMATICALLY IMPLIES UNRESERVED ACCEPTANCE OF THESE GENERAL TERMS AND CONDITIONS OF SALE IN THEIR ENTIRETY.
The PLAYER's acceptance of these GTC is indicated by ticking the box next to the statement “I have read the General Terms and Conditions of Sale and accept them without reservation” [TO BE CONFIRMED]. By doing so, the PLAYER acknowledges having fully read and approved, without exception or reservation, all the GENERAL TERMS AND CONDITIONS set out below.
ARTICLE 1. DEFINITIONS
The following terms have the meanings set out below in these GENERAL TERMS AND CONDITIONS OF SALE:
“ORDER” means any purchase by the PLAYER of one or more ITEMS offered by FULLLIFE on its SHOP.
“GENERAL TERMS AND CONDITIONS OF SALE” (or “GTC”) means the contractual terms made available on the SHOP governing any ORDER placed on the SHOP by a PLAYER.
“GENERAL TERMS AND CONDITIONS OF USE” (or “GTU”) means these contractual terms made available on the SHOP governing the use of the SHOP by any USER or PLAYER.
“CAPSULE” means a reward earned by the PLAYER in return for their involvement in the FULLLIFE community and ecosystem. Each CAPSULE may contain various rewards: FL COINS, PHILOSOPHY POINTS, cards unlocking LOCKED PRODUCTS, etc.
“COLLECTIONS” means the various collections of PRODUCTS or ITEMS offered on the SHOP, comprising three types of COLLECTION:
“CORE” means the COLLECTION of basics available on the SHOP all year round.
“DROP” means a limited-time COLLECTION, most often created in collaboration with an artist, personality or partner brand. These are event COLLECTIONS available for a limited period and may include RARE PRODUCTS.
“PRO” means the COLLECTION of technical products offered on the SHOP all year round.
“FL COINS” means FULLLIFE loyalty points. FL COINS are awarded to the PLAYER in CAPSULES as a reward for purchasing PRODUCTS or ITEMS on the SHOP, completing a COMMUNITY QUEST or taking part in a campaign run by a FULLLIFE partner. FL COINS may be used to pay for ORDERS on the SHOP. The conversion rate between FL COINS and euros can be viewed on the SHOP at the time of the ORDER and in the PLAYER's PROFILE. FL COINS are valid for fifty (50) days from the date on which they are acquired.
“LOGIN CREDENTIALS” means the email address and password required to access a PROFILE on the SHOP.
“PARTIES” means the USER or PLAYER, on the one hand, and FULLLIFE, on the other.
“PLAYER” means a USER registered on the SHOP who warrants that they are a consumer within the meaning of French law and case law. The PLAYER acts outside any habitual or commercial activity.
“PHILOSOPHY” means one of the different motivational profiles that PLAYERS may choose to follow. Each PRODUCT or ITEM offered by FULLLIFE is linked to a PHILOSOPHY, and an ORDER for an ITEM therefore adds PHILOSOPHY POINTS to the PLAYER's PROFILE. The PHILOSOPHIES are presented on the SHOP.
“PHILOSOPHY POINT” means a point acquired either through the purchase of PRODUCTS or ITEMS or through CAPSULES, and associated with one of the eight PHILOSOPHIES developed by FULLLIFE. PHILOSOPHY POINTS can unlock LEGENDARY PRODUCTS associated with the relevant PHILOSOPHY. PHILOSOPHY POINTS are valid for one LEGENDARY PRODUCT season (approximately 12 months). FULLLIFE may decide at any time to start a new LEGENDARY PRODUCT season and reset to zero all PHILOSOPHY POINTS collected by PLAYERS. FULLLIFE undertakes to inform PLAYERS at least 30 days before a season change.
“SHOP” means the online shop accessible at https://www.full.life.
“PRODUCT” or “ITEM” means clothing, accessories and any other articles offered on the SHOP and as part of the SERVICES offered by FULLLIFE to PLAYERS.
“LOCKED PRODUCT” means a PRODUCT that the PLAYER cannot freely ORDER and that may be unlocked according to its category as described below.
“RARE PRODUCT” means a LOCKED PRODUCT that a PLAYER may purchase only if they obtain an unlock card in a CAPSULE.
“LEGENDARY PRODUCT” means a LOCKED PRODUCT that a PLAYER may purchase only in exchange for PHILOSOPHY POINTS. Each LEGENDARY PRODUCT is associated with one of the eight PHILOSOPHIES and may be purchased only with PHILOSOPHY POINTS associated with the relevant PHILOSOPHY. LEGENDARY PRODUCTS are renewed each season (a season lasts approximately 12 months). At the start of each new LEGENDARY PRODUCT season, the PLAYER's PHILOSOPHY POINT balance is reset to zero.
“PROFILE” means the interface on the SHOP that contains all the data provided by the PLAYER. The PROFILE is accessed using the PLAYER's LOGIN CREDENTIALS.
“COMMUNITY QUEST” means an announced or hidden challenge offered by FULLLIFE. Such challenges may take various forms, including solving coded puzzles, finding hidden hyperlinks, achieving scores in video games or participating in real-world or virtual events. This list is not exhaustive; new forms of COMMUNITY QUEST may be developed regularly. Completing a COMMUNITY QUEST earns CAPSULES.
“DISCOUNTS” means the offers and discount vouchers applicable to the price of an ORDER, as defined in these GTC.
“SERVICES” means all features and other services offered by FULLLIFE to USERS and PLAYERS through the SHOP.
“USER” means any natural person who accesses and browses the SHOP.
ARTICLE 2. PURPOSE
These GTC govern all aspects of the preparation, conclusion, performance, payment, tracking and delivery of any ORDER placed on the SHOP. These GTC, together with the GTU, PRIVACY POLICY and COOKIE POLICY, form an indivisible contractual whole governing relations between the PARTIES, to the exclusion of any earlier version of contractual terms available on the SHOP.
Any matter necessary for the performance or interpretation of these GTC that is not expressly addressed shall be governed by the rules and practices applicable to distance-selling companies with their registered office in France.
FULLLIFE may amend these GTC at any time. The GTC applicable between the PARTIES are those available online when the PLAYER places the ORDER.
ARTICLE 3. SERVICES OFFERED ON THE SHOP
Article 3.1. Sale of PRODUCTS
FULLLIFE offers various COLLECTIONS of PRODUCTS or ITEMS inspired by gaming and esports on its SHOP.
FULLLIFE offers three types of COLLECTION:
- “CORE”: the COLLECTION of basics available on the SHOP all year round;
- “DROP”: a limited-time COLLECTION, most often created in collaboration with an artist, personality or partner brand. These are event COLLECTIONS available for a limited period and may include RARE PRODUCTS;
- “PRO”: the COLLECTION of technical products offered on the SHOP all year round.
Some PRODUCTS cannot be freely ORDERED. These LOCKED PRODUCTS fall into two categories:
- RARE PRODUCTS may be ordered only if the PLAYER has an unlock card obtained in a CAPSULE;
- LEGENDARY PRODUCTS may be ordered only in exchange for PHILOSOPHY POINTS acquired through the PLAYER's use of the SHOP and its SERVICES.
Article 3.2. Pre-orders
PRODUCTS available for pre-order are reserved by the PLAYER on the SHOP.
A pre-order is handled in the same way as a standard order insofar as the PLAYER pays online when ORDERING the PRODUCT.
For pre-orders, FULLLIFE informs the PLAYER of the expected delivery times. Delivery times are specified on the SHOP for each new PRODUCT offered for pre-order. These times may vary, particularly due to production lead times, unforeseen events or force majeure.
The withdrawal period and return conditions applicable to pre-orders are the same as those applicable to standard orders.
ARTICLE 4. ORDERS
The PARTIES expressly agree that the data recorded by FULLLIFE in connection with an ORDER constitutes evidence of all commercial transactions concluded between them.
ORDERS are placed on the SHOP.
To place an ORDER, the PLAYER may create a PROFILE or log in to an existing PROFILE in order to select the desired PRODUCTS and quantities.
The PLAYER may also place an ORDER as a guest, without creating a PROFILE.
In that case, the PLAYER forgoes the benefit of CAPSULES and PHILOSOPHY POINTS.
A guest USER must provide only the information necessary to process the ORDER. At the end of the purchase process, the guest USER may register as a PLAYER or continue as a USER.
An electronic invoice will be available by clicking the PDF document in the ORDER confirmation email.
From the virtual basket, the PLAYER can access the “Checkout” section. The PLAYER must then provide certain information concerning delivery and the desired payment method. Until the ORDER is confirmed, the PLAYER may abandon or amend it at any time.
The sale is validly concluded when the PLAYER pays the price.
Once the PLAYER confirms the ORDER, an email confirming the ORDER and its payment is sent as soon as possible to the email address associated with the PLAYER's PROFILE.
Any amendment to an ORDER after confirmation by the PLAYER requires FULLLIFE's prior written consent. FULLLIFE reserves the right to revise the originally proposed price and delivery times accordingly.
Provided that it informs the PLAYER concerned as soon as possible, FULLLIFE reserves the right to refuse any ORDER:
- On legitimate grounds, in particular if the quantities of PRODUCTS ordered are unusually high for a consumer, or if the information provided with the ORDER is inconsistent with consumer status or suggests a payment irregularity;
- If the ORDER is placed by a PLAYER who has not paid for a previous ORDER in full or with whom a dispute is ongoing.
FULLLIFE reserves the right to limit ORDERS so that as many people as possible can benefit from PRODUCTS offered on the SHOP. Such limits may be occasional quantity restrictions per PLAYER with the same name, per delivery to the same address or per PROFILE holder. These restrictions may be stated on the SHOP.
Because quantities are limited, some PRODUCTS may be temporarily or permanently out of stock. ORDERS are therefore subject to availability.
If an ordered PRODUCT is unavailable, FULLLIFE undertakes to inform the PLAYER concerned and offer a replacement PRODUCT of equivalent quality and price, or a credit note equal to the price of the unavailable PRODUCT.
If the PLAYER refuses, FULLLIFE undertakes to refund the PLAYER within fourteen (14) days of the request.
ARTICLE 5. PRODUCT DESCRIPTIONS AND APPLICABLE PRICES
Before placing an ORDER, the PLAYER may view the essential characteristics and price of the desired PRODUCT(S) on the SHOP.
The price of each PRODUCT is shown in euros (€) on its description page.
By placing an ORDER, the PLAYER accepts the prices and descriptions of the PRODUCTS offered for sale on the SHOP.
Prices may be updated at any time without notice, but PRODUCTS are invoiced at the price displayed when the ORDER is recorded. Prices become payable in full after confirmation of the ORDER.
All prices are stated in euros excluding taxes, which are borne by the PLAYER. Applicable taxes are those provided for by the regulations in force. If those regulations change, any resulting price changes take effect on the date the changes come into force.
The price including taxes is shown before the ORDER is confirmed.
PRODUCT pages show prices excluding delivery costs, which are added when the ORDER is finalized.
For delivery outside metropolitan France, the ORDER may be subject to taxes and/or customs duties, which are borne exclusively by the PLAYER. The PLAYER is responsible for making the necessary enquiries and payments to the competent authorities.
ARTICLE 6. PAYMENT TERMS
Article 6.1. Payment by the PLAYER
ORDERS are paid for in euros (€).
The PLAYER may pay for an ORDER online:
- By bank card, by entering a valid card number and expiry date and the digits on the back of the card;
- Using the FL COINS available in the PLAYER's PROFILE, under the conditions set out in Article 6.3 below;
- By combining FL COINS with a bank card payment for the balance.
Any prompt refund to the PLAYER's account in the event that a PRODUCT is unavailable shall not give rise to any compensation.
Article 6.2. Discount offers
DISCOUNTS are valid only for the period and under the conditions specified in the relevant offer. DISCOUNTS may under no circumstances be converted into an amount refundable or payable to the Customer.
DISCOUNTS may be used only by the PLAYER concerned and are not transferable to a third party. They are deducted from the total ORDER amount including taxes, excluding ORDER preparation and delivery costs. Unless a particular DISCOUNT offer states otherwise, DISCOUNTS cannot be combined when placing an ORDER.
If the PLAYER enters several DISCOUNTS on the SHOP at the same time, only the DISCOUNT with the highest value may be applied to the same ORDER.
Article 6.3. FL COINS
FL COINS acquired by the PLAYER through CAPSULES received from FULLLIFE may be used only by that PLAYER and are not transferable to a third party.
FL COINS may under no circumstances be converted into an amount refundable or payable to the PLAYER.
FL COINS have a limited validity period shown to the PLAYER in their PROFILE. This period may not exceed 50 days from the date on which the PLAYER obtains the CAPSULE.
At the end of their validity period, unused FL COINS are forfeited without compensation to the PLAYER.
The PLAYER may use FL COINS to pay for an ORDER under the following conditions:
- If the value of the FL COINS the PLAYER wishes to use is less than the total amount of the ORDER including taxes but excluding preparation and delivery costs, the PLAYER must pay the difference as well as the ORDER's preparation and delivery costs;
- If the value of the FL COINS the PLAYER wishes to use equals the total amount of the ORDER including taxes but excluding preparation and delivery costs, the PLAYER must pay only the preparation and delivery costs of the ORDER.
Article 6.2. Information processed by FULLLIFE
The PLAYER warrants to FULLLIFE that they have the authorizations required to use their chosen payment method for the ORDER. Confirmation of the ORDER is subject to approval by FULLLIFE's chosen bank payment centre.
If the bank declines payment, the ORDER is not finalized and is cancelled. To combat online fraud, FULLLIFE may transmit information relating to the ORDER and the PLAYER's payment method to authorized third parties for verification.
FULLLIFE, together with the bank managing electronic payments, checks all ORDERS confirmed on the [website not specified in source]. For example, FULLLIFE may check any ORDER with a delivery address different from the PLAYER's billing address. In this context, FULLLIFE may request information and documents necessary to fulfil the ORDER, such as proof of address for the PLAYER and/or the person named at the delivery address, or evidence relating to the PLAYER's bank details. Such requests are made to the PLAYER by email or telephone.
The bank account linked to the payment method used by the PLAYER will be debited when the PLAYER finalizes the ORDER on the [website not specified in source]. FULLLIFE may suspend or cancel any ORDER and/or delivery, regardless of its nature or stage of fulfilment, in the event of total or partial non-payment of any amount owed by the PLAYER or a payment incident (collectively, an “INCIDENT”). Subsequently, FULLLIFE may refuse any new ORDER from the PLAYER or suspend a delivery to the PLAYER if an INCIDENT occurred with a previous ORDER. FULLLIFE will inform the PLAYER where applicable.
Once the PLAYER has paid for the ORDER affected by an INCIDENT, or the INCIDENT has been resolved so that the ORDER can be paid for and finalized, FULLLIFE will erase the personal data it has recorded in relation to that INCIDENT. If the INCIDENT is not resolved, the personal data relating to it will be retained for two (2) years from the date on which the INCIDENT occurred. Once FULLLIFE has erased the personal data relating to an INCIDENT, either because it has been resolved or because the two-year period has expired, the PLAYER concerned may place new ORDERS.
Article 6.3. Information processed by the payment intermediary
To ensure the security, integrity and confidentiality of payments made via the [website not specified in source], PLAYERS' bank card details are encrypted using the SSL (Secure Socket Layer) protocol while transmitted over the Internet.
Information relating to the PLAYER's payment method is processed securely by FULLLIFE's payment service provider, Hipay, and by the bank (and PayPal, where applicable) in order to process and authorize payment for the ORDER, analyze bank transactions and combat bank card fraud.
Hipay retains information relating to the payment method used for an ORDER for a maximum of fifteen (15) months from the last payment or the end of the contractual relationship and, in all cases, no later than the payment method's expiry date.
Non-payment arising from fraudulent use of a bank card may result in details associated with that non-payment being recorded in a payment incident file maintained by Hipay. An irregular declaration or anomaly may also be subject to specific processing by Hipay.
ARTICLE 7. DELIVERY
The delivery area covers France (metropolitan France and overseas territories) and every Member State of the European Union.
PRODUCTS are shipped to PLAYERS through a carrier selected by FULLLIFE.
Exceeding the delivery time indicated when the ORDER was placed does not, in itself, entitle the PLAYER to damages.
Article 7.1. Deliveries in France
PRODUCTS are delivered to the address given by the PLAYER when placing the ORDER. The PLAYER is responsible for checking that the ORDER matches their selection and that their personal details, delivery method and address, options and billing address are correct.
Delivery charges are borne by the PLAYER if the value of the ORDER is less than EUR 89 including taxes; they include the cost of shipping the ORDER. They are shown when the ORDER is confirmed.
Express delivery charges are always borne by the PLAYER, regardless of the ORDER amount.
The delivery deadline for metropolitan France is a maximum of seven (7) business days from the date of the ORDER, subject to its confirmation and depending on the method selected by the PLAYER (Standard, Express or Collection Point).
FULLLIFE makes every effort to deliver the ORDER as quickly as possible and, in all cases, within a maximum of 30 days from the date of ORDER confirmation.
Article 7.2. International delivery
PRODUCTS offered for sale on the SHOP are delivered only to the countries and territories listed below:
Belgium, Germany, Luxembourg, the Netherlands, Austria, Ireland, Italy, Portugal, Spain, the United Kingdom, Switzerland, Bulgaria, Croatia, the Czech Republic, Denmark, Estonia, Finland, Greece, Hungary, Latvia, Lithuania, Malta, Poland, Romania, Slovakia, Slovenia, Sweden, Andorra, Vatican City State, Guadeloupe, Guernsey, Bouvet Island, the Isle of Man, Iceland, Jersey, Réunion, Liechtenstein, Mayotte, Monaco, Norway, San Marino, Svalbard and Jan Mayen, and Martinique.
Delivery charges are borne by the PLAYER and include preparation and shipping costs for the ORDER. They are shown when the ORDER is confirmed and when it is placed.
Article 7.3. Delivery delays / Lost parcels
In the event of a delivery delay, FULLLIFE undertakes to notify the PLAYER as soon as possible, by any means of communication, and to indicate the estimated length of the delay.
If a parcel is lost, FULLLIFE may investigate with the delivery operator to locate it. If the ORDER is found, it is immediately reshipped to the PLAYER at FULLLIFE's sole expense.
If the PLAYER has not received the ORDER within a maximum of 30 days from the date of ORDER confirmation, the PLAYER may cancel the ORDER by emailing FULLLIFE to notify it of that decision.
For the purposes of these GTC, delivery shall be deemed to have occurred, or the ORDER to have been delivered, when the PLAYER or a third party designated by the PLAYER takes physical possession of the ORDER, as evidenced by signing the acknowledgement of receipt of the ORDER at the delivery address provided by the PLAYER.
If the PLAYER cancels the ORDER under the conditions described above, FULLLIFE shall refund the PLAYER within fourteen (14) days of the PLAYER's cancellation of the ORDER.
If the PLAYER cancels the ORDER, the FL COINS awarded as a reward for that ORDER, including those obtained through a CAPSULE linked to it, shall be deducted from the PLAYER's FL COINS balance.
Article 7.4. Non-conforming / Damaged ORDER
Despite the care FULLLIFE takes in preparing and shipping parcels, some ORDERS may contain missing, damaged or non-conforming PRODUCTS.
On delivery of the ORDER, and if the delivery method provides for it, the PLAYER may be asked to sign a delivery note. The PLAYER must check the conformity of the PRODUCT and the condition of its packaging on receipt. If the PLAYER considers the delivered PRODUCTS to be faulty, defective or non-conforming, the PLAYER must refuse delivery or submit reasoned reservations to FULLLIFE describing the defect or non-conformity of the ORDER. The PLAYER has thirty (30) clear days from delivery to submit a complaint to FULLLIFE.
FULLLIFE will not provide a refund or exchange if the complaint is submitted after that deadline.
The PLAYER may submit complaints to FULLLIFE by email at npc@full.life or by writing to the registered office address stated in the preamble to these GTC. The complaint must specify the number of the cancelled ORDER in order to obtain a return number.
After reviewing the complaint and registering the request, FULLLIFE will send the PLAYER a return label so that the damaged or non-conforming PRODUCTS may be returned.
The PRODUCT must be returned in the condition it was in upon receipt, in its original packaging and with all documents, instructions and accessories, together with the ORDER invoice.
FULLLIFE will inform the PLAYER of the PRODUCT's return. The PLAYER may then choose:
- Delivery of a PRODUCT identical to the defective PRODUCT;
- If delivery of an identical PRODUCT is impossible, delivery of a PRODUCT of equivalent quality and price;
- A full refund of the price of the ordered PRODUCT within fourteen (14) days.
The cost of returning and exchanging the defective PRODUCT shall be borne by FULLLIFE.
No PRODUCT will be exchanged or refunded if the defect is found to be attributable to the PLAYER, in particular if it results from use outside the PRODUCT's normal purpose or an alteration or adaptation made at the PLAYER's initiative.
ARTICLE 8. RIGHT OF WITHDRAWAL / PRODUCT RETURNS
Article 8.1. The PLAYER's right and period of withdrawal
The PLAYER has thirty (30) clear days from confirmation that the ORDER has been shipped to exercise the right of withdrawal without giving a reason.
To exercise the right of withdrawal:
- The PLAYER must log in to their PROFILE and select the relevant ORDER, allowing them to create a return request by selecting the ITEMS they wish to send back;
- A USER who ordered as a guest must notify FULLLIFE of the decision to withdraw by an unequivocal statement sent to npc@full.life.
FULLLIFE will acknowledge receipt of the withdrawal on a durable medium (for example, by email). Returns are free of charge within metropolitan France, and FULLLIFE will provide the PLAYER with a downloadable prepaid return label.
Only a new, unworn and unsoiled PRODUCT will be refunded. The PRODUCT must be returned in its original packaging or, failing that, in packaging providing equivalent protection, together with its PRODUCT label.
For hygiene reasons, underwear (boxers, socks, etc.) cannot be returned, exchanged or refunded.
Article 8.2. Return arrangements
Returns from France
Returns via Mondial Relay [source also contains the words “postal mail”] are free of charge and must be made within 30 days from confirmation that the ORDER has been shipped, after approval by FULLLIFE.
To make a return:
- The Customer must prepare the parcel by placing the clean, unworn, unwashed PRODUCT(S), with their labels and original packaging, inside it;
- Affix the return label to the parcel and drop it off at a Mondial Relay collection point;
- Keep proof of drop-off. In the event of a dispute or loss of the parcel by the carrier, the drop-off receipt will serve as evidence and allow the returned PRODUCT(S) to be refunded.
Returns from abroad
Returns from abroad must also be made within 30 days from confirmation that the ORDER has been shipped.
Return shipping costs are borne by the PLAYER. The PLAYER must email FULLLIFE at npc@full.life.
FULLLIFE will then send the PLAYER all the steps to follow for the return.
The PLAYER must arrange for a carrier to collect the parcel and deliver it to FULLLIFE at the following address:
Fulllife - Exte Logistika
600 route de Bidache
40300 Hastingues
France
Upon receipt of the parcel, FULLLIFE will email the PLAYER to acknowledge receipt and refund the returned PRODUCT(S) within 15 business days of receiving the parcel. The refund will be made using the payment method used for the ORDER.
For example:
- If the PLAYER paid by bank card, FULLLIFE will credit that card;
- If the PLAYER paid for the ORDER with FL COINS, the number of FL COINS used will be credited back to the PLAYER's PROFILE, subject to the same expiry date as the FL COINS originally used;
- If the PLAYER paid for the ORDER partly with FL COINS and partly by bank card, FULLLIFE will credit the FL COINS used for the ORDER back to the PLAYER's PROFILE and, if the value of those FL COINS is less than the price of the returned PRODUCT(S), credit the balance to the bank card.
The refund method cannot be changed.
When one or more PRODUCTS are refunded following a return, the benefits (including FL COINS) contained in any CAPSULE(S) obtained by the PLAYER as a result of ordering the relevant PRODUCT(S) will be cancelled.
If the PLAYER has already used some of those benefits, FULLLIFE reserves the right to refuse the return or deduct all or part of the used benefits from the refund.
For any questions about returns, the PLAYER may email npc@full.life.
ARTICLE 9. WARRANTIES
In accordance with applicable laws and regulations, and without prejudice to any contractual warranty granted by FULLLIFE, all ORDERS are subject to the statutory guarantee of conformity under Articles L.217-4 et seq. of the French Consumer Code and the warranty against hidden defects under Articles 1641 et seq. of the French Civil Code.
Article 9.1. Statutory guarantee of conformity
The PLAYER:
- Has two years from delivery of the PRODUCT to bring a claim;
- May choose between repair and replacement of the PRODUCT, subject to the cost-related conditions laid down in Article L.217-9 of the French Consumer Code;
- Is not required to prove that the PRODUCT's lack of conformity existed at the time of delivery if it becomes apparent within 24 months of delivery.
The statutory guarantee of conformity applies independently of any commercial warranty that may be granted.
Article L.217-4 of the French Consumer Code:
The seller shall deliver goods that conform to the contract and shall be liable for any lack of conformity existing at the time of delivery.
The seller shall also be liable for any lack of conformity resulting from the packaging, assembly instructions or installation where installation was the seller's responsibility under the contract or was carried out under the seller's responsibility.
Article L.217-5 of the French Consumer Code:
Goods conform to the contract:
- If they are fit for the purpose usually expected of similar goods and, where applicable:
- If they correspond to the description given by the seller and have the qualities presented by the seller to the buyer in the form of a sample or model;
- If they have the qualities that a buyer may legitimately expect in view of public statements made by the seller, the producer or their representative, particularly in advertising or labelling;
- Or if they have the characteristics agreed by the parties or are fit for any special purpose sought by the buyer, brought to the seller's attention and accepted by the seller.
Article L.217-7, paragraph 1, of the French Consumer Code:
Any lack of conformity that becomes apparent within twenty-four months of delivery of the goods shall be presumed to have existed at the time of delivery, unless proven otherwise.
Article L.217-9 of the French Consumer Code:
In the event of a lack of conformity, the buyer may choose between repair and replacement of the goods.
However, the seller need not follow the buyer's choice if it entails a manifestly disproportionate cost compared with the other option, taking account of the value of the goods or the significance of the defect. The seller must then, unless impossible, provide the other remedy.
Article L.217-10 of the French Consumer Code:
If repair and replacement of the goods are impossible, the buyer may return the goods and receive a refund of the price, or retain them and receive a partial refund.
The buyer has the same right:
If the remedy requested, proposed or agreed under Article L.217-9 cannot be implemented within one month of the buyer's complaint;
If that remedy cannot be implemented without major inconvenience to the buyer, considering the nature of the goods and the intended use.
However, rescission of the sale cannot be ordered if the lack of conformity is minor.
Article L.217-11 of the French Consumer Code:
The provisions of Articles L.217-9 and L.217-10 shall be applied at no cost to the buyer.
These provisions do not prevent an award of damages.
Article L.217-12 of the French Consumer Code:
An action arising from a lack of conformity must be brought within two years of delivery of the goods.
Article 9.2. Warranty against hidden defects
The PLAYER may invoke the warranty against hidden defects in the goods within the meaning of Article 1641 of the French Civil Code and, in that event, may choose between rescission of the sale and a reduction of the purchase price in accordance with Article 1644 of the French Civil Code.
Article 1641 of the French Civil Code:
The seller is bound by the warranty for hidden defects in the item sold that render it unfit for its intended purpose or impair that use to such an extent that the buyer would not have purchased it, or would have paid a lower price for it, had the buyer known of the defects.
Article 1643 of the French Civil Code:
The seller is liable for hidden defects even if unaware of them, unless, in that case, the seller stipulated that no such warranty would apply.
Article 1644 of the French Civil Code:
In the cases covered by Articles 1641 and 1643, the buyer may choose to return the item and receive a refund of the price, or retain it and receive a partial refund of the price, as assessed by experts.
Article 1646 of the French Civil Code:
If the seller was unaware of the defects, the seller shall only be required to refund the price and reimburse the buyer for the costs incurred in connection with the sale.
Article 1648, paragraph 1, of the French Civil Code:
An action based on redhibitory defects must be brought within two years of discovery of the defect.
Article 9.3. Exclusion of warranty
The PLAYER may not rely on any statutory or contractual warranty if:
- The damage or defect is apparent (and the PLAYER did not make a complaint under the conditions applicable to the right of withdrawal);
- The damage or defect is attributable to transportation of the PRODUCT where the PLAYER entrusted delivery to a carrier other than one offered by FULLLIFE;
- The damage or defect results from abnormal use of the PRODUCT by the PLAYER;
- The PRODUCT has been modified, adapted or repaired without FULLLIFE's authorization.
ARTICLE 10. INTELLECTUAL PROPERTY
All intellectual property and other rights relating to the SHOP, including copyright, trademarks, designs and models, database rights and any other intellectual property rights, are and remain the exclusive property of FULLLIFE or, in the case of licensed technologies, their authors and/or owners.
In accordance with and within the limits of Article L.342-1 of the French Intellectual Property Code, FULLLIFE prohibits the extraction or reuse of all or part of the content of its SHOP.
The PLAYER acknowledges these ownership and intellectual property rights and shall take no action to infringe, limit or restrict FULLLIFE's ownership or rights in relation to the SHOP in any way.
If the PLAYER wishes to use in another context and/or disseminate data, information and/or content from the SHOP or relating to the PRODUCTS offered, the PLAYER must first submit a written request to FULLLIFE's registered office.
The PLAYER agrees not to use the SHOP for commercial purposes or to rent, lend, sell, publish, offer to license or sublicense, distribute, assign or otherwise transfer all or part of the SHOP to any third party without FULLLIFE's express prior written authorization, which FULLLIFE may make subject to payment.

ARTICLE 12. COOKIES

ARTICLE 13. AMENDMENTS
FULLLIFE may amend these GTC at any time, particularly to comply with a legal provision. The PLAYER will be informed of amendments as described below.
The new version of the GTC will be available in the relevant section of the PORTAL. The PLAYER must accept the GTC when placing an ORDER, before choosing a payment method.
If the GTC are amended, the applicable version is the one in force on the date of the ORDER. A dated copy of that version may be provided to the PLAYER upon request.
ARTICLE 14. TERMINATION
If either PARTY breaches its obligations and fails to remedy that breach within fifteen (15) days of receiving a registered letter with acknowledgement of receipt notifying it of the breach, the other PARTY may terminate the ORDER immediately and as of right.
If the ORDER is terminated, the PLAYER remains liable for payment of all earlier ORDERS fulfilled by FULLLIFE up to the effective date of termination and, more generally, for payment of any invoices due to FULLLIFE and remaining unpaid despite the termination.
ARTICLE 15. GENERAL PROVISIONS
The fact that either PARTY has not required compliance with any provision of these GTC, whether permanently or temporarily, shall not constitute a waiver of that provision.
In the event of any difficulty interpreting a heading preceding a provision, the heading shall be disregarded.
ARTICLE 16. JURISDICTION AND GOVERNING LAW
THESE GTC AND THE RELATIONSHIP BETWEEN THE USER AND FULLLIFE ARE GOVERNED BY FRENCH LAW.
In the event of a dispute between FULLLIFE and a USER or PLAYER concerning the interpretation, performance or termination of these GTC, the PARTIES shall endeavour to resolve it amicably.
If no agreement is reached, an optional mediation procedure will be proposed in a spirit of fairness and good faith, with a view to reaching an amicable settlement of any dispute relating to this contract, including its validity.
Pursuant to Article L.616-1 of the French Consumer Code, in the event of a dispute the USER or PLAYER may also refer the matter to a consumer mediator at the Association des Médiateurs Européens (AME Conso), accessible at https://www.mediationconso-ame.com/, or use any other alternative dispute resolution procedure.
The PARTY wishing to initiate mediation must first inform the other PARTY by registered letter with acknowledgement of receipt, stating the details of the dispute.
As mediation is not compulsory, the USER, PLAYER or FULLLIFE may withdraw from the process at any time.
IF MEDIATION FAILS OR IS NOT PURSUED, THE DISPUTE THAT COULD HAVE BEEN REFERRED TO MEDIATION SHALL BE SUBMITTED TO THE COURTS WITHIN THE JURISDICTION OF THE PAU COURT OF APPEAL.
